This agreement sets out the terms and conditions through which mytxt.co.uk Limited ("mytxt", "the company") provides Services to mobile phone users.

1. Definitions
 
"We", "Us" or "Our" means mytxt.co.uk Limited.
"You" or "Your" refers to the customer.
"advertising material","Promotions", "promotional material", "advertising" or "adverts" refers to the same.
 
 
2. This Agreement
 
This agreement represents the entire and only agreement between the parties relating to the subject matter of this agreement. It supersedes any previous drafts, agreements, representations, undertakings and warranties or arrangements.
 
This agreement starts when you initiate a Service. These terms and conditions represent the agreement. We may alter or amend at any time the terms in this agreement.
 
We reserve the right to change this Agreement from time to time and post the new version on our website.
 
We will not be liable for factors beyond our control that prevent The Company from meeting the terms of this agreement. These include but are not limited to terrorism, floods, earthquakes, lightning, operator or third party error, theft or emergencies.
 
 
3. Background and Services
 
The Company offers mobile content such as Chat and Tarot services delivered via the SMS (Short Message Services). The Services are aimed as adults and all users of our Services must be at least 18 years of age.
 
 
4. Support and Complaints
 
If you have any enquiry or reason to complain about the Services delivered by The Company, a dedicated Customer Service function exists which can be contacted using the following means:

5. Charges
 
The following short codes are associated with the the Services: 193222, 19704444.
The cost of sending a message to the short codes is $0.25 per SMS.
The cost of receiving a message from the short codes is $3.50 per SMS.
 
Instructional messages such as spend warnings or Service welcome messages are free to receive.
 
Individual networks may apply monthly or daily usage caps in respect of the total amount that can be spent on a service. Check with your respective Mobile Network to determine the maximum spend limits.
 
You may incur charges when downloading certain Services to your mobile phone. Standard GPRS connection and download charges will apply.
 
 
6. Liability
 
The Company has no liability to you or any other person resulting from any losses or damages that you or anyone else may incur. Similarly, The Company has no liability if another persona makes uses of your mobile phones without your permission.

The Company accepts no liability for associated acts, omission or errors of providers of telecommunication Services or for faults in or failures of their networks and equipment.
 
 
7. Privacy Policy
 
The use of our Services is governed by the Mobile Network operators.  Data collected from customers by us may be used by the Mobile Networks for regulatory purposes.
 
 
8. Acceptable Use Policy
 
The Services provided by The Company are for use by individuals aged 18 or over. They are not suitable for use by children
 
Parents and guardians will be held responsible for the actions of any children that use our Services.
 
Failure to follow the guidelines set out in this agreement indemnifies The Company against all costs, demands, actions, costs, expenses, losses and damages arising from or incurred as a result of your actions.
 
 
9. Provision of Services
 
Where necessary, The Company may temporarily suspend the Services as a result of required maintenance. Where possible, notice will be given. No guarantee is given that the service will be error free or be interrupted.
 
Reasonable care is taken to ensure that information from you is securely held. We accept no responsibility for any damages that you may suffer as a result of the loss of the confidentiality of information input or sent to us in connection with our Services.
 
The Company does not resell user data. Data remains within the domain of The Company unless required by the relevant law or regulator.
 
In replying to a promotion, you are initiating the advertised service. You have a right to cancel the promotions or services. You will not be entitled to any refund of that fee. To exit any of the Services, send an SMS message containing the word STOP to the given short code.
 
Once you have initiated a service with The Company, you will be considered "opted-in" to receive promotions related to The Service.
 
 
10. Termination
 
Under any of the following conditions, we can suspend or limit your usage of our Services or terminate this Agreement (or both) with immediate effect if:
 
- Your account becomes dormant
- We have reason to believe your account will not be paid
- The use of our Services is likely to be damaged or interrupted
